Arbitration panels

A separate arbitration panel is constituted for each case. Each panel consists of five arbitrators and is interdisciplinary in composition. This diversity of expertise ensures a well-founded and balanced assessment of often complex facts of a case, properly taking account of aspects relevant to both law and history/art history in the proceedings.

Arbitrators are selected from the list of arbitrators. Each party has four weeks to select two arbitrators – one qualified in law and one qualified in history/art history. The parties do not contact the arbitrators directly; communication is handled through the Service Desk. If an arbitrator is requested but unable to take up the position in the specific case for factual or legal reasons, the Service Desk informs the party concerned and asks them to select another person.

Once appointed, the four arbitrators jointly select one further member from the list to serve as chairperson of the arbitration panel. This person should preferably be a judge, but a legally qualified person (jurist) may also be chosen.
